Tuli Terms of Service and Privacy Policy

1. Description of the Service

Tuli provides a secure, private platform for Users to:

• Create and share personal photos and videos.
• Build collaborative albums where invited friends can add, edit, and view content.
• Engage in group chats associated with specific albums for discussions and coordination.

The Service is available on mobile devices via the Tuli app. To use certain features, you may need to create an account and grant permissions for camera, photo library, and notifications access.

2. Eligibility and User Accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. By using Tuli, you represent that you meet this age requirement and have the legal capacity to enter into this Agreement.

To access the Service, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at support@tuliapp.com if you suspect unauthorized use.

We reserve the right to suspend or terminate accounts for violations of these Terms.

3. User Content and Licenses

User Content Definition: "User Content" includes any photos, videos, albums, messages, or other materials you upload, share, or generate through the Service.

You retain ownership of your User Content but grant Tuli a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, display, reproduce, modify, and distribute your User Content solely as necessary to operate, provide, and improve the Service (e.g., for backups, thumbnails, or sharing with invited collaborators).

By uploading User Content, you represent and warrant that:

• You own or have necessary rights to the content.
• It does not violate any third-party rights (e.g., privacy, intellectual property).
• It complies with these Terms.

Collaborators in albums and group chats have limited rights to view, add to, or interact with the content, but only as permitted by the album owner.

Tuli does not claim ownership of User Content but may remove any content that violates these Terms or applicable laws.

4. User-Generated Content Moderation and Safety

Content Moderation System:

• Automated Filtering: We employ automated systems to detect and filter objectionable content, including but not limited to explicit material, hate speech, harassment, and violent content.
• User Reporting: Users can flag objectionable content and report abusive users directly through in-app reporting mechanisms.
• User Blocking: Users have the ability to block other users to prevent further interaction.
• 24-Hour Response: We commit to reviewing and acting on all content reports within 24 hours of submission.

Consequences for Violations:

• Content that violates our guidelines will be removed immediately.
• Users who post objectionable content or engage in abusive behavior will be subject to immediate account suspension or permanent termination.
• Repeat offenders will be permanently banned from the platform.

Prohibited Content Includes:

• Illegal content or content promoting illegal activities
• Sexually explicit, pornographic, or obscene material
• Hate speech targeting race, ethnicity, religion, gender, sexual orientation, or other protected characteristics
• Harassment, bullying, threats, or intimidation
• Violent, graphic, or glorifying violence content
• Spam, fraudulent, or misleading content
• Content that infringes on intellectual property rights
• Personal information of others without consent

By using Tuli, you agree to report any violations you encounter and to refrain from posting any content that violates these guidelines.

5. Prohibited Activities

You agree not to:

• Upload or share illegal, harmful, abusive, or infringing content (e.g., child exploitation, hate speech, copyrighted material without permission).
• Use the Service for commercial purposes without our written consent.
• Interfere with the Service (e.g., hacking, viruses, scraping).
• Harass, impersonate, or spam other Users.
• Share content that reveals sensitive personal information without consent.

We may monitor User Content for compliance but do not guarantee the accuracy or safety of shared content. Report violations to support@tuliapp.com.

6. In-App Purchases and Subscriptions

Tuli may offer in-app purchases and subscriptions through the Apple App Store. All purchases are subject to Apple's terms and conditions.

Restore Purchases Feature:

• Users can restore previously purchased in-app purchases using the "Restore Purchases" feature available in the app settings.
• This feature allows users to recover their purchases when switching devices or reinstalling the app.
• Restoration requires being logged into the same Apple ID used for the original purchase.

Subscription Terms:

• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Account will be charged for renewal within 24 hours prior to the end of the current period.
• Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription.

7. Intellectual Property

The Service, including its design, code, and trademarks (e.g., "Tuli"), is owned by Tuli or its licensors and protected by intellectual property laws. You are granted a limited, revocable license to use the Service for personal, non-commercial purposes.

If you believe your intellectual property has been infringed, contact us at support@tuliapp.com with details for review under applicable laws (e.g., DMCA).

8. Third-Party Services

The Service may integrate with third-party services (e.g., device storage, cloud backups). Your use of such services is subject to their terms, and Tuli is not responsible for them.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violations, with or without notice. Upon termination, your account and User Content may be deleted, except as required by law.

Sections of these Terms that by nature should survive termination (e.g., licenses, disclaimers) will do so.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation.

User Content is shared at your own risk; Tuli is not liable for disputes between Users or loss of data.

11. Limitation of Liability

To the fullest extent permitted by law, Tuli, its affiliates, and personnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility.

Our total liability shall not exceed $100 or the amount you paid us in the preceding 12 months, whichever is greater.

12. Indemnification

You agree to indemnify and hold Tuli harmless from claims arising from your User Content, violations of these Terms, or use of the Service.

13. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts in Delaware.

14. Miscellaneous

This Agreement constitutes the entire agreement. If any provision is invalid, the rest remains enforceable. No waiver of any term is a continuing waiver. You may not assign this Agreement without our consent; we may assign it freely.

Personal Information:

• Account details: Name, email, username (if provided during signup).
• Profile information: Phone number, profile picture (optional).

Content and Usage Data:

• User Content: Photos, videos, albums, and chat messages you upload or share.
• Device and usage info: IP address, device ID, app version, usage patterns (e.g., albums created, chats joined), crash logs.

Protected Resource Access:

• Camera: Used to capture photos and videos that you can share with other users. For example, you can take pictures of moments you want to share in the app.
• Photo Library: Used to let you select existing photos and videos to share, and to save new content you create in the app to your camera roll.
• Microphone: Used to record audio for videos you create and share with other users in the app.
• Location: Used to show you content relevant to your area and connect you with nearby users. For example, you can discover local events and people in your vicinity.

Automatically Collected Data:

• Cookies and analytics: We use tools like Google Analytics to track app performance and user interactions (anonymized where possible).

We do not collect sensitive information (e.g., health, financial data) unless you voluntarily share it in User Content.

For collaborative features, we collect participant lists for albums and chats, but access is limited to invited Users.

2. How We Use Your Information

We use your information to:

• Provide and maintain the Service (e.g., store albums, deliver chats).
• Improve functionality (e.g., analyze usage for bug fixes).
• Communicate with you (e.g., notifications, support responses).
• Ensure security and prevent fraud (e.g., detect suspicious activity).
• Moderate content and enforce our community guidelines.
• Comply with legal obligations.

We do not sell your personal information.

3. Sharing Your Information

We share information only as necessary:

• With Service Providers: Trusted third parties (e.g., cloud storage like AWS, analytics providers) who help operate the Service, bound by confidentiality.
• With Other Users: Limited to collaborators in your albums/chats (e.g., they see shared photos and messages).
• Legal Reasons: If required by law, subpoena, or to protect rights/safety.
• Business Transfers: In case of merger, acquisition, or sale of assets.

We do not share with advertisers or for marketing without consent.

4. Data Security

We implement reasonable administrative, technical, and physical safeguards (e.g., encryption for data at rest/transit, secure servers) to protect your information. However, no system is completely secure, and we cannot guarantee absolute protection.

User Content is stored privately; albums and chats are end-to-end encrypted where feasible, but you are responsible for not sharing sensitive content.

5. Your Rights and Choices

Depending on your location (e.g., GDPR for EU Users, CCPA for California), you may have rights to:

• Access, correct, or delete your personal information.
• Opt out of data sharing or targeted ads (though we do not use targeted ads).
• Withdraw consent.
• Manage app permissions (e.g., camera access) via device settings.

Delete your account anytime in the app settings, which removes your data (subject to backups).

6. Children's Privacy

Tuli is not intended for children under 13. We do not knowingly collect data from children. If we learn of such collection, we will delete it promptly. Parents/guardians: Contact us if you believe your child has provided information.

7. International Data Transfers

Tuli operates in the US but may transfer data globally. We ensure adequate protections (e.g., standard contractual clauses) for international transfers.

8. Changes to This Privacy Policy

We may update this Policy to reflect changes in practices or laws. We'll notify you via app notification or email for material changes. Continued use constitutes acceptance.
